2. Website Operator

This Website is operated by Dr. S. Hussain, a clinical practice based in Siwan, Bihar. For contact details, refer to Section 12 below and the Privacy Policy.

3. Permitted Use

You may use the Website only for lawful, personal, and non-commercial purposes, including:

• Browsing publicly available informational pages.
• Submitting an appointment request through the /appointment page in good faith.
• Viewing search-engine-optimised pages about clinical services and focus areas.

• Scrape, crawl, copy, or republish Website content by automated means or manual harvesting without prior written consent.
• Carry out, incite, or facilitate DDoS, vulnerability scanning, or any other activity that disrupts or degrades Website availability.
• Attempt to access, probe, or brute-force the staff-only /staff/* paths, admin panels, APIs, or any protected area for which you have not received explicit credentials.
• Submit false, misleading, or unlawful content through any form or endpoint.

The name Dr. S. Hussain and the practice tagline are unregistered marks used in good faith to identify the clinical practice. Registration status is pending where applicable. No reproduction, framing, or use of these marks is permitted without prior written consent.

5. Appointment Requests

Submission of an appointment request via a POST to /api/v1/appointment-requests (or the public form at /appointment) does not create a confirmed appointment. A valid, confirmed appointment exists only when clinic staff explicitly contact the patient by phone or email to confirm date, time, and any specific arrangements.

The reference number returned upon successful form submission is an acknowledgement of receipt only. It does not constitute a booking confirmation.

6. User Obligations

• Accurate details: You agree to provide accurate, up-to-date, and truthful contact details (full name, mobile number, etc.) when submitting any form on the Website.
• No test/fake requests: You agree not to submit test entries, fake appointment requests, or duplicate submissions for the same intent. Form endpoints are rate-limited; abusive submissions may receive 429 Too Many Requests responses and may be blocked at network or application level. Idempotency keys are used to track and deduplicate repeated submissions.
• Minors: Appointment requests on behalf of minors (under 18) must be submitted by a parent or legal guardian. A guardian must be present at the in-person consultation.

7. Availability

The Website is provided on an “as available” basis. Reasonable efforts are made to maintain uptime during normal operation. However, no representation or warranty is made that access to the Website will be uninterrupted, timely, or error-free. Maintenance windows may occur from time to time, during which some or all features may be temporarily unavailable.

8. Limitation of Liability

To the maximum extent permitted by the laws of India, the clinic, Dr. S. Hussain, and all associated persons shall not be liable for any indirect, consequential, incidental, special, exemplary, or punitive damages—including, without limitation, loss of data, loss of profit, business interruption, or loss of opportunity—arising out of or in connection with your access to, use of, or inability to use this Website, even if advised of the possibility of such damages.

In no event shall the total aggregate liability of the clinic for any and all claims related to your use of the Website exceed the total amount, if any, actually paid by you to the clinic in the 12 months immediately preceding the incident giving rise to the claim.

You agree to indemnify, defend, and hold harmless Dr. S. Hussain, the clinic, its staff, and affiliates from and against any and all third-party claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from:

• Your breach of any provision of these Terms of Use.
• Your violation of any applicable law, regulation, or third-party right.
• Any content you submit, transmit, or otherwise make available through the Website.

10. Termination of Access

The clinic reserves the right, in its sole discretion, to terminate, suspend, or block your access to the Website at any time and without prior notice, for any violation of these Terms of Use or any other conduct that the clinic deems harmful to its interests, other users, or the public.

11. Governing Law & Jurisdiction

These Terms of Use and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of India.

The courts of competent jurisdiction in Siwan, Bihar, India shall have exclusive venue for the settlement of any such dispute or claim.

These Terms of Use may be updated at the clinic’s discretion at any time, with or without prior notice. The “Date of last review” line at the top of this page will be updated when changes are made. Continued use of the Website after such changes constitutes acceptance of the revised terms.
